These Terms and Conditions ("Terms") govern your access to and use of  www.luxurystayz.com ("we," "our," or "us"). By using our website and services, you agree to abide by these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into agreements to use our website and services. By using our website, you represent and warrant that you meet these eligibility requirements.

 

2. Use of Services

2.1 Booking and Payment: Our website allows you to browse and book luxury accommodations. When making a booking, you agree to provide accurate and complete information, including payment details, and you agree to pay all applicable fees and charges.

2.2 Accommodation Standards: The luxury accommodations featured on our website meet high standards of quality and service. However, we do not guarantee the accuracy of the information provided by hosts.

2.3 Prohibited Activities: You agree not to engage in any illegal, harmful, or abusive activities on our website. This includes, but is not limited to, using the website for fraudulent purposes, spamming, and disrupting the normal functionality of the website.

3. Booking and Cancellation Policy

Booking Policy

1. Any bookings made by You with Luxury Stayz will incur a 25% non-refundable deposit which will be charged at the time of booking to secure the reservation. The balance of the moneys payable for the booking must be received no less than 30 days prior to the booking scheduled commencement date and is non-refundable.

2. Acceptance of a booking is subject to receipt of the deposit and confirmation of the booking. If a booking is made within 30 days prior to commencement of a booking, payment in full is required.

3. For reservations made through third-party platforms (e.g., Airbnb, Expedia), the balance may be charged earlier than the 6-week mark in accordance with the policies of the specific platform. In such cases, Luxury Stayz is not responsible for the charged balance, and it will remain non-refundable.

4. You can request changes within these times subject to season and availability.

Cancellation Policy

1.If a booking is cancelled more than 60 days prior to your stay you will be entitled to a full refund less a $200 admin fee.
 

2. For cancellations request within 60 and 30 days of the booking commencement date, the 25% deposit will be retained.  However, if we manage to re-lease the property within your booking dates, Luxury Stayz will refund the balance minus a $200 admin fee.

 

3. For cancellation within 30 days of arrival, no refund will be given unless the property is re-leased during your booking terms. We will refund the balance minus the $200 admin fee.
 

4. Exceptionally, for cancellations during the end of year festive season (December and January), no refund will be given for cancellations requests received less than 90 days prior to the booking commencement date.  A full refund minus the $200 admin fee will only be applicable if the booking is cancelled 90 days prior to the commencement of a booking and the refund is subject to the property being re-let for the same booking term and rates.

4. Intellectual Property

All content, including but not limited to text, images, graphics, logos, and trademarks on our website, is our intellectual property or the intellectual property of our licensors. You may not use, reproduce, or distribute any content without our express written consent.

 

5. Privacy

Our Privacy Policy governs the collection, use, and disclosure of your personal information. By using our website, you consent to the terms of our Privacy Policy.

6. Limitation of Liability

To the maximum extent permitted by law, we disclaim all liability for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our website or services, even if we have been advised of the possibility of such damages.

7. Indemnification

You agree to indemnify and hold us, our affiliates, officers, employees, and agents harmless from any claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising out of or in connection with your use of our website or services.

We may, in our sole discretion, terminate or suspend your access to our website and services for any reason, including if we believe you have violated these Terms.
